Bank account / payment details

As stated in the individual confirmation or automated booking email

In these Terms and Conditions, the operator identified above is referred to as the “Provider”. The person making a booking or using the accommodation is referred to as the “Guest”.

2. Purpose and scope

These Terms and Conditions apply to bookings for Palmera Apartment – La Mata made through the website, by email, by telephone or by another method agreed in writing, and to use of the accommodation.

These Terms and Conditions form part of the agreement between the parties when a booking request is submitted or the booking is finalised. Before finalisation, the Provider makes the essential booking conditions available to the Guest.

If an individual written confirmation provides otherwise, that confirmation takes precedence for the booking concerned, provided it does not conflict with mandatory law.

3. Key features of the accommodation

Palmera Apartment – La Mata is an apartment in Torre La Mata, Torrevieja. According to the website, it is on the second floor of a building with a lift, approximately 100 metres from the beach.

  • The entire apartment is for the Guest’s exclusive use during the booking period.
  • The accommodation has an area of approximately 60–64 m², with two bedrooms, a living room, kitchen, bathroom and terrace.
  • Maximum occupancy: 6 guests.
  • The accommodation is intended for families, couples and guests seeking a short or longer holiday.
  • The main amenities listed on the website are Wi-Fi, a kitchen, balcony/terrace, non-smoking rooms, parking and airport transfers on request.

Guests with accessibility requirements, young children, health-related needs or other special requirements must consult the Provider before booking, as the website description does not replace an individual suitability check.

4. Booking process

A booking may be requested through the website, by email, by telephone or by another written method agreed in advance.

A booking request submitted through the website or an automated system message does not, by itself, constitute a confirmed booking. The booking becomes final only when the Provider has confirmed it in writing and any required advance payment or earnest-money deposit has been received by the specified deadline.

For a booking request, the Guest must provide at least the arrival and departure dates, number of guests, contact details and any information required for invoicing or mandatory reporting to the authorities, where applicable.

The Provider may reject a booking request if the requested dates are unavailable, the permitted occupancy would be exceeded, the Guest fails to provide required information or the booking would be for a purpose contrary to the house rules.

5. Contract formation and communication

The contract is formed when the Provider issues written confirmation and any required payment is made. Written communication includes email and any electronic message that the parties can retrieve later.

The language of the contract is Hungarian unless the parties agree otherwise in writing. The Provider sends the essential booking details and conditions to the Guest by email.

The Guest must check the details in the confirmation and notify the Provider immediately of any discrepancy or error.

6. Prices and charges

The accommodation price is per night for use of the entire apartment by 1–6 guests. The price is set for the apartment, not per person.

Prices and availability on the website may be indicative. The final price, payment deadline and any additional charges are always set out in the written confirmation or automated booking email.

Additional charges may include, without limitation, cleaning fees, a security deposit, airport transfers, late arrival or departure, lost keys, exceptional cleaning and any applicable local charges or taxes required by law.

Obvious typographical errors, technical faults, incorrect system prices or availability information do not constitute a binding offer. In such cases, the Provider may correct the error and inform the Guest of the correct conditions.

7. Payment

Payment arrangements are agreed in advance. Available payment methods include:

  • bank transfer
  • cash
  • another payment method agreed in advance

The Provider may require an advance payment or earnest-money deposit to finalise the booking. Its exact amount, legal nature, payment deadline and bank transfer details are specified in the automated email or written confirmation.

Where the confirmation specifies an advance payment, it is credited towards the total accommodation price. Where it expressly identifies the amount as an earnest-money deposit, the legal consequences apply as set out in the individual confirmation.

If the advance payment or earnest-money deposit is not received by the deadline, the Provider may cancel the booking or offer the dates to another Guest.

8. Cancellation and changes

The Guest may cancel the booking in writing at the booking and complaints email address: spalfi@netquality.hu.

The booking may be cancelled in writing at least five days before arrival. Any refund of the advance payment or earnest-money deposit is governed by the individually confirmed conditions.

If the Guest fails to arrive without cancelling in advance, the advance payment or earnest-money deposit is non-refundable unless the Provider decides otherwise individually and in writing.

Changes to dates, guest numbers or other essential booking details are subject to availability and the Provider’s written confirmation. A price difference or additional charge may apply.

The 14-day right of withdrawal without giving a reason generally does not apply to accommodation bookings for specific dates. Cancellation is governed by these Terms and Conditions and the individual confirmation.

9. Arrival, departure and key handover

  • Check-in: from 15:00
  • Check-out: by 11:00

Different arrival or departure times require prior agreement and the Provider’s written confirmation.

The Guest must give advance notice of any significant delay in arrival. The Provider communicates the details of key handover, access and departure individually.

The departure time must be respected to allow cleaning and the smooth arrival of the next guests. Late departure may incur an additional charge if previously communicated by the Provider or if the delay causes actual loss.

10. Occupancy and use of the accommodation

No more than six people may stay in the apartment. Occupancy above the number stated in the booking requires the Provider’s prior written consent.

The apartment may not be transferred to third parties, sublet or used for events, parties, business functions or activities that disturb the residential community.

The Guest is responsible for ensuring that accompanying persons and anyone they admit comply with these Terms and Conditions and the house rules.

11. House rules

The Guest must use the accommodation properly, respect the peace of the building and neighbourhood, and comply with the house rules communicated by the Provider.

In particular, the following are prohibited:

  • holding parties, events or loud gatherings;
  • accommodating more guests than permitted;
  • disturbing neighbours, residents or other guests;
  • misusing equipment, appliances or furniture;
  • damaging the accommodation, common areas or building facilities;
  • handing over or transferring the apartment to a third party;
  • engaging in unlawful activities or activities contrary to public morals.

The Provider may terminate use of the accommodation in the event of serious or repeated breaches of the house rules. If termination results from the Guest’s breach of contract, the Guest is not entitled to a refund for the unused period.

12. Smoking, pets, noise and common areas

The apartment is non-smoking. Smoking inside is prohibited. Breaching this rule may result in an extra cleaning charge, compensation for damage or termination of use of the accommodation.

Pets are not allowed unless the Provider has agreed otherwise in writing in advance.

The Guest must use the building’s common areas appropriately and use the lift, stairwell, entrance and parking facilities in accordance with local rules.

13. Cleaning, equipment and proper use

The Guest must use the apartment, furnishings, appliances, kitchen utensils and linen properly.

On departure, the Guest must leave the apartment generally tidy, dispose of rubbish as agreed, close windows and doors, and switch off air conditioning and electrical appliances when no longer needed.

The Provider may recover reasonable costs from the Guest in the event of exceptional soiling, misuse, lost keys, damaged equipment or breaches of the rules.

14. Security deposit and damage

The Provider may request a security deposit to cover damage, lost keys, misuse or extra cleaning. Its amount, payment method and refund conditions must be communicated before finalising the booking or in the written confirmation.

The Guest is liable for damage caused by them, their companions or anyone they admit.

In the event of damage, lost keys, exceptional soiling or misuse, the Guest must bear the reasonable costs of repairs, replacement, lock changes, extra cleaning or other justified expenses.

The Guest must immediately report any defect, damage or malfunction to the Provider and may be liable for additional damage caused by delayed reporting.

15. Airport transfers and additional services

The airport transfer advertised on the website is available on request by prior arrangement. It is not automatically included in the accommodation price unless expressly stated in the individual confirmation.

Availability, prices, cancellation and performance conditions for additional services are agreed separately. Where a service is provided by an external partner, the Provider is responsible only to the extent of its actual control.

16. Website use and technical conditions

The website presents the accommodation, facilitates booking enquiries and enables communication. Images, descriptions and prices are indicative; the final conditions are always those stated in the written confirmation.

The Provider is not responsible for technical problems on the Guest’s side, such as an incorrect email address, messages sent to spam, internet connection faults or problems with the Guest’s device.

Website content, images and texts may be protected by copyright. Copying, republishing or commercial use without the Provider’s prior consent is prohibited.

17. Liability

The Provider makes the accommodation available as described in the confirmation and on the website, in a condition suitable for its intended use.

The Provider is not liable for damage, accidents, lost valuables or problems arising from the Guest’s own fault, negligence, breaches of the house rules or improper use.

The Guest must look after their valuables, close doors and windows when leaving the apartment and use equipment properly.

The Provider is not responsible for failures or interruptions of external services beyond its direct control. These may include utilities, internet, building maintenance, weather, official measures, transport delays or unexpected events in the neighbourhood.

Nothing in these Terms and Conditions excludes or limits the Provider’s liability under mandatory applicable law.

18. Force majeure

Force majeure means any unforeseeable, unavoidable event beyond the parties’ control that makes fulfilment of the booking impossible or disproportionately difficult.

Examples include natural events, official measures, utility outages, public-health or travel restrictions, unexpected building or neighbourhood events, strikes, transport disruption and other unavoidable external circumstances.

In the event of force majeure, the parties must cooperate and seek a fair, practical solution. Force majeure does not relieve them of obligations that can still reasonably be performed in the circumstances.

19. Complaints

The Guest must immediately report any problem, defect or complaint during the stay so that the Provider can attempt to resolve it before departure.

For complaints or problems, please use the following contact details:

  • E-mail: spalfi@netquality.hu
  • Phone: +36 20 967 2658
  • Website contact: info@palmeraapartment.com

The Provider can meaningfully investigate a complaint made after the stay only if the issue was also reported during the stay and the Provider had an opportunity to address it.

The Provider investigates complaints and responds within a reasonable time. The parties primarily seek an amicable solution through discussion.

If the booking constitutes a consumer contract, the Guest may have mandatory consumer-protection rights and access to dispute-resolution procedures. These Terms and Conditions neither exclude nor limit those rights.

20. Personal data processing

The Provider processes personal data supplied during booking and communication solely to manage the booking, communicate, fulfil legal and official obligations, issue invoices, handle complaints and damage claims, and pursue legitimate claims.

Detailed data-processing rules are set out in a separate Privacy Policy, available at: https://palmeraapartment.com/adatvedelmi-nyilatkozat/.

The Guest acknowledges that certain information may be required to fulfil the booking, issue invoices or comply with local legal obligations.

21. Cookies and newsletters

The website may use cookies for operation, preference management, statistics or marketing measurement. Detailed cookie rules are available in the website’s cookie settings and cookie notice.

If the Guest subscribes to the newsletter, the Provider or newsletter service provider uses the supplied data to manage subscriptions and unsubscriptions. Newsletters may be sent only with the Guest’s consent.

22. Applicable law and dispute resolution

The accommodation is in Spain, so the applicable Spanish rules also govern use of the accommodation, the stay itself, building rules and local operating requirements.

Booking matters are governed primarily by the individual written confirmation, these Terms and Conditions, the house rules and mandatory applicable law.

The parties first seek to resolve disputes through discussion. If unsuccessful, the Guest may use the consumer-protection, administrative or judicial remedies provided by mandatory law. These Terms and Conditions do not restrict the Guest’s mandatory rights.

The European Union’s former online dispute resolution platform closed on 20 July 2025. Its link should therefore not be presented in the website’s Terms and Conditions as a mandatory dispute-resolution option.

23. Amendments to these Terms

The Provider may amend these Terms and Conditions unilaterally. Amendments take effect when published on the website or sent to the Guest.

Amendments will not adversely affect already confirmed bookings unless justified by a change in law, an official requirement or an unavoidable circumstance affecting fulfilment of the booking.

24. Final provisions

If any provision is invalid or unenforceable, the remaining provisions remain valid. The parties will replace it with a valid provision whose economic and practical purpose is as close as possible to the original.

Matters not covered by these Terms and Conditions are governed by the individual confirmation, house rules, mandatory applicable law and written agreements between the parties.
